June 7th: a roundtable within the framework of the Copyright School was held on the topic "Seeking disproportionate compensation for violations of exclusive rights: abuse or prevention of recidivism?"

The roundtable was organized by the Legal Bureau "Omega", Digital IP with the support of the Ministry of Finance of Russia. The event was moderated by the CEO of the Legal Bureau "Omega", PhD Uvarkin Gennady and the Director of Digital IP, PhD Chukovskaya E.E.

Many famous experts took part in the discussion, including the CEO of IPCodex Polianchik N.A., Managing Partner of Semenov & Pevzner Lukyanov R.L., Professor of the Department of Civil and Business Law of the RFTA, Associate Professor of the Department of Intellectual Rights of the Kutafin University (MSAL), PhD Vasilyeva E.N., Deputy CEO of the Legal Bureau "Omega" Gusev S.V.,CEO of the Legal Bureau "Omega", PhD Leontiev K.B., Senior Lawyer-Consultant of the Legal Bureau "Omega", PhD Nagrodskaya V.B., Associate Professor of the Department of Civil Law of the O.E. Kutafin University (MSAL), Candidate of Law Morgunova E.A.

During the roundtable practical aspects of running business in the field of intellectual property were discussed, where experts shared their experience and tips on successfully combating plaintiffs who abuse their rights. The main focus was on effective protection strategies and evasion of procedural abuses.

The experts also discussed the detailed steps in obtaining a claim:
- The importance of early response to the situation, including the opportunity to file a motion to move the case to the general procedure;
- Providing sufficient evidence of the legal use of materials, including contracts, screenshots proving the existence of the work on other resources, etc.;
- Attention to copyright details and investigation of the actual circumstances of the use of the work;
- Argumentation for reducing compensation, counter-calculation and many others.

The participants of the roundtable exchanged their experience and concluded about the possibilities of legislative regulation of this issue.
